Terms of Use

1. Scope and provider

These terms of use govern the use of the apps and services of Matchday Manager (football and hockey, hereinafter the "Service"). The provider is Production Build (Owner: Raphael Stäbler), Bischofsweg 31, 60598 Frankfurt am Main, Deutschland (hereinafter "we"). By registering and using the Service, you accept these terms.

2. The Service

Matchday Manager is a fantasy-sport manager: within a budget you put together a virtual team of real players from the Swiss top flight or the top Swiss ice-hockey league, choose a captain and chips, plan transfers and collect points matchday by matchday, based on the real performances of the players. It is about entertainment and sporting competition with other users.

3. Not gambling

Participation in the Service is free of charge and does not involve any stake of money to win money. Matchday Manager is not gambling and not a sports bet. Any rankings, titles or awards are of a purely symbolic nature.

4. Account and registration

To use the Service you need an account. Login is passwordless via a one-time code sent to your email address or via "Sign in with Apple" or "Sign in with Google". You are obliged to provide correct information and to protect your access from unauthorised use. As a rule, one account per person is permitted.

5. Minimum age

Use of the Service requires a minimum age of 16 years. If the age required for consent to data processing is higher in your country of residence, that age applies.

6. Rules of conduct

When using the Service, you undertake in particular,

• not to use any unlawful, offensive, discriminatory content or content that infringes the rights of third parties — this also applies to the manager name you choose and to league names;
• not to impair the Service through automation, multiple accounts, manipulation or exploitation of technical errors, or to gain unfair advantages for yourself;
• not to use any malware and not to endanger the security or integrity of the Service.

We may change or remove inappropriate manager names or content and, in the event of breaches, suspend accounts temporarily or permanently.

7. User-generated content and feedback

You remain responsible for content that you submit within the Service (e.g. manager and league names). If you send us feedback or suggestions for improvement, we may use these to further develop the Service free of charge, without any claims arising for you as a result.

8. Availability and changes

We endeavour to keep operation as uninterrupted as possible, but we do not owe any particular level of availability. Maintenance, further development, game rules, points and price logic as well as the scope of functions may change. We may discontinue the Service — for example due to a lack of data availability or for economic reasons — in whole or in part; we will announce material restrictions with reasonable notice where possible.

9. Intellectual property

The Service and all associated content, software, trade marks and designs are protected by copyright and trade-mark law and remain with us or the respective rights holders. We grant you a non-exclusive, non-transferable, revocable right to use the Service for your personal, non-commercial use. Player, club and league names are used exclusively for information purposes within the context of the fantasy game; there is no connection to or endorsement by the leagues or clubs mentioned.

10. Liability

We are liable without limitation in the event of intent and gross negligence as well as for damage arising from injury to life, body or health. In the case of ordinary negligence, we are liable only for the breach of a material contractual obligation (cardinal obligation) and limited to the damage typical for the contract and foreseeable. Otherwise liability is excluded. Mandatory statutory provisions, in particular under product liability and consumer protection law, remain unaffected. As the Service is provided free of charge, we accept no warranty in particular for the accuracy of game data, points, prices or rankings.

11. Term and termination

The usage relationship runs for an indefinite period. You can delete your account and all associated data at any time — in the app under Profile → Account & Privacy → Delete account or by a message to [email protected]. We may terminate the usage relationship with reasonable notice and end it without notice for good cause — in particular in the case of serious breaches of these terms.

12. Changes to these terms

We may amend these terms of use, for example in the event of changes to the Service or the legal situation. We will inform you of material changes in an appropriate manner (e.g. in the app or by email). If you do not object and continue to use the Service, the amended terms are deemed accepted; otherwise you can delete your account.

13. Applicable law and place of jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected; as a consumer you may also bring proceedings against us at your place of residence. Where a place of jurisdiction can be freely agreed, Frankfurt am Main is the place of jurisdiction.
